This Privacy Policy explains how Twin Cities Infant Gear LLC d.b.a. Baby Gear Group Twin Cities (“Baby Gear Group,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit www.twincities.babygeargroup.com (the “Site”), create or manage a membership account, rent baby gear on an à la carte basis, or otherwise use our services (collectively, the “Services”), whether you access the Services directly or through a third party.

Baby Gear Group operates from Minnesota and primarily serves families locally. Our Services are offered in the United States and intended for U.S. residents, though the Site may be accessed from elsewhere. If you do not agree with this Policy, please do not use the Site or the Services.

1. Personal Information We Collect

We collect the categories of personal information described below. When we say “personal information,” we mean information that identifies, relates to, or could reasonably be linked to you or your household.

A. Device & Usage Information

When you visit the Site, we automatically collect information about your device and how you interact with the Site, including your IP address, browser type, device identifiers, time zone, referring/exit pages, the pages and products you view, and date/time stamps. We collect this using cookies, log files, and web beacons/tags/pixels. See Section 5 (Cookies & Tracking).

B. Account & Membership Information

To use features such as renting inventory, you create an account and agree to our Terms of Service and Liability Waiver. We collect your name, email address, phone number, login credentials, and your membership tier and status. If you sign up with a third-party login (e.g., Google or Facebook), we receive limited profile information from that provider in accordance with its privacy policy.

C. Order, Rental & Payment Information

When you place a rental or purchase order, we collect your billing and delivery address(es), delivery preferences, the items you rent or buy, rental start/return dates, and records of item condition, damage, or loss on return. We may also collect your due date and/or delivery date(s) so we can time deliveries and recommendations.

Payment information. Payments are processed by Stripe, our third-party, PCI-DSS-compliant payment processor. When you pay, your credit card or account details are collected and processed by that processor. We do not store full payment card numbers on our systems; we retain limited information such as a payment token, the card brand, the last four digits, and transaction records needed for billing, refunds, deposits, and fraud prevention.

D. Sensitive Information

Some information we collect may be considered “sensitive” under certain state laws. This may include your due date or delivery date (which can indicate pregnancy or reproductive-health timing) and, if you choose to provide it, household details such as whether anyone in your home smokes or whether you have pets. We collect this information only to provide and personalize the Services — for example, to schedule deliveries, recommend appropriate gear, and prepare and clean items appropriately. We do not use or disclose sensitive information except as needed to provide the Services you request, as permitted by law, or with your consent, and you may ask us to limit our use of it (see Section 9).

E. Information You Submit

We collect information you provide directly: ratings and reviews of items, responses to surveys or contests, support requests (by phone, email, or in person at our locations), newsletter sign-ups, and content you post in any public area of the Services. Information you post publicly may be seen by others; please do not include personal information you want kept private.

F. Information About Other People

If you send a gift card or refer a friend, you may give us that person’s name and email and any message you include. We use that information only to send the gift card or referral and to track the program, consistent with this Policy.

2. How We Use Personal Information

We use personal information to:

  • Provide the Services — create and manage your account, process and fulfill rentals and orders, schedule deliveries and returns, process payments, deposits, and refunds, and provide invoices and confirmations;
  • Personalize the Services — recommend gear and tailor your experience based on your preferences, due/delivery dates, and rental history;
  • Communicate with you — send account, order, and rental updates (including by phone, email, and text) and respond to your questions;
  • Market to you — send newsletters, promotions, and offers (you can opt out at any time; see Sections 6 and 9);
  • Improve and develop the Services — analyze usage and interest in features and items;
  • Protect against fraud and ensure safety — verify identity and address for rentals, screen orders for risk, and protect our rights, property, and users; and
  • Comply with law — meet legal obligations and respond to lawful requests.

We may use aggregated or deidentified data, which does not identify any individual, for any lawful purpose, and we will maintain and use such data in deidentified form.

3. How We Share Personal Information

We share personal information in the following ways:

  • Service providers. With vendors that perform functions on our behalf — payment processing, delivery, IT and hosting, analytics, customer support, CRM, and marketing operations — under contracts that limit their use of the information to providing services to us.
  • Advertising and analytics partners. With third parties that help us measure and deliver advertising. Depending on the technologies used, this may involve cookies or identifiers being shared for cross-context behavioral advertising. See Sections 5–6, and your opt-out rights in Section 9.
  • Marketing “Partners.” From time to time we run promotions with screened brands. We share only aggregated or deidentified segment information that we believe cannot reasonably be linked to an individual, unless you have consented to more.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case personal information may be transferred to the successor entity.
  • Legal and safety. To comply with law or lawful requests (such as subpoenas or court orders), enforce our agreements, and protect the rights, safety, and property of Baby Gear Group, our users, and the public.

“Sale” and “share.” Some state laws define a “sale” broadly to include disclosing personal information for value, and a “share” to include disclosing it for cross-context behavioral advertising. Our use of third-party advertising cookies and similar technologies may be considered a “sale” or “share” under those laws. We do not knowingly sell or share the personal information of anyone we know to be under 16. You can opt out as described in Sections 6 and 9.

4. Accounts, Memberships & Rentals

Membership billing. If your membership renews automatically, we store the information needed to bill and renew it, including your plan, renewal date, and payment token. We will tell you how to view, change, or cancel your plan and how renewal and cancellation affect billing in your account settings and our Terms of Service.

Managing your account. You can review and update most account information by logging in. To close your account, contact us using the methods detailed in Section 13. After closure, we retain limited information as described in Section 8 (for example, transaction and tax records and to resolve disputes about returned items).

Rental records. To operate rentals, we keep records of items rented, delivery and return dates and addresses, deposits, and the condition of items on return (including notes about damage or loss). We use these to fulfill rentals, manage deposits and fees, maintain inventory safety, and prevent fraud.

5. Cookies, Tracking & Opt-Out Preference Signals

We and our partners use cookies, log files, web beacons, tags, and pixels to operate the Site, remember your preferences, analyze traffic (for example, with Google Analytics), and deliver and measure advertising. You can manage cookies through your browser settings; disabling some cookies may affect how the Site works.

Opt-out preference signals (Global Privacy Control). Where required by law, we recognize the Global Privacy Control (GPC) and similar browser-based opt-out preference signals as a valid request to opt out of the “sale” or “sharing” of personal information and of targeted advertising for that browser or device. Because these signals are device- or browser-specific, you may need to set them on each browser and device you use. To extend an opt-out to your whole account, also submit a request under Section 9.

6. Behavioral / Interest-Based Advertising

We work with advertising companies that may collect information about your visits to our Site and other websites over time, using cookies and similar technologies, to show you ads that may interest you. We follow the self-regulatory principles of the Network Advertising Initiative (NAI) and Digital Advertising Alliance (DAA).

These opt-outs are cookie-based, so you must renew them if you clear cookies or use a new browser or device. You can also opt out using GPC (Section 5) or by submitting a request (Section 9).

7. Text Messaging (SMS) Program

If you provide your mobile number and opt in, we may send you account, order, and rental messages and — with your consent — marketing messages. Your participation is governed by these terms:

  • Consent is not a condition of purchase or of using the Services. You may decline marketing texts and still rent and buy from us.
  • Message frequency varies, up to 2 times per month for marketing purposes and as needed for account operations and membership or rental deliveries. Message and data rates may apply, charged by your mobile carrier.
  • Reply STOP to any message to opt out of that program, and HELP for help. Opting out of marketing texts does not stop transactional messages about an active rental or order.
  • We use your number for the messaging purposes you consented to and do not share mobile opt-in data with third parties for their own marketing.

8. Data Retention

We keep personal information only as long as needed for the purposes described in this Policy, after which we delete or deidentify it. How long we keep information depends on factors such as:

  • the length of your membership and rental relationship with us, plus a reasonable period afterward to handle returns, deposits, disputes, and warranty or guarantee claims;
  • legal, tax, accounting, and recordkeeping obligations;
  • the need to detect and prevent fraud and to enforce our agreements; and
  • whether you ask us to delete the information (see Section 9).

We may be unable to delete some information where we are required or permitted to retain it — for example, completed transaction records. When we no longer need information, we securely delete or deidentify it.

9. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights with respect to your personal information:

  • Know / Access. Request the categories and specific pieces of personal information we have collected about you, and how we use and disclose it.
  • Correct. Request that we correct inaccurate personal information.
  • Delete. Request that we delete personal information we collected from you, subject to legal exceptions.
  • Portability. Request a copy of certain personal information in a portable format.
  • Opt out of sale/sharing and targeted advertising. Direct us not to “sell” or “share” your personal information or use it for targeted advertising (see Sections 5–6).
  • Limit sensitive information. Ask us to limit our use of sensitive information to what is necessary to provide the Services.
  • Withdraw consent. Where we rely on your consent, withdraw it at any time.

How to submit a request

You may submit a request by emailing twincities@babygeargroup.com, calling us at (651) 359-6678. We provide at least two methods so you can reach us online or by phone.

Verification. To protect you, we will take reasonable steps to verify your identity before acting, which may require you to confirm information we already have. We will not use verification information for any other purpose.

Authorized agents. You may use an authorized agent to submit a request on your behalf; we may require proof of authorization and verification of your identity.

Appeals. If we decline your request and your state provides a right to appeal, you may appeal by replying to our decision or contacting us at the address in Section 13. We will respond within the time your state law requires. If your appeal is denied, you may contact your state Attorney General.

Non-discrimination. We will not discriminate or retaliate against you for exercising your privacy rights.

10. State-Specific Disclosures

Minnesota Residents

Baby Gear Group is based in Minnesota. Under the Minnesota Consumer Data Privacy Act, in addition to the rights in Section 9, Minnesota residents may:

  • Obtain a list of third parties. Request a list of the specific third parties to which we have disclosed your personal data (or, at our option, personal data generally).
  • Question profiling. If we engage in profiling in furtherance of decisions that produce legal or similarly significant effects, you may question the result, be informed of the reason, and — where applicable — review the data used and be told what you could have done differently.
  • Appeal. If we deny a request, you may appeal as described in Section 9, and you may contact the Minnesota Attorney General if your appeal is denied.

California Residents

In the prior 12 months, we have collected the categories of personal information described in Section 1, including identifiers, account and order information, commercial information (rental and purchase history), internet/device activity, geolocation (approximate, from IP), payment information, and — if provided — sensitive information such as due/delivery dates. We collect it from you, your devices, and our service providers, and use and disclose it for the purposes in Sections 2–4.

We disclose personal information to service providers, advertising/analytics partners, and as required by law. We may “sell” or “share” identifiers and internet activity for cross-context behavioral advertising; you can opt out under Sections 5–6 and 9. We do not knowingly sell or share the personal information of consumers under 16.

Shine the Light. California residents may request information about disclosures of personal information to third parties for their direct-marketing purposes by contacting us at twincities@babygeargroup.com.

11. Children’s Privacy

The Services are intended for adults age 18 and older. We do not knowingly collect personal information directly from children under 13 (or as defined by applicable law). Because we serve families, account holders may give us information related to an infant or child (such as a due date or a child’s age) — we treat that information as the account holder’s information and use it only to provide the Services. If you believe a child has provided us personal information directly, contact us at twincities@babygeargroup.com and we will delete it as required by law.

12. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information during transmission and storage, including using Stripe, a PCI-DSS-compliant processor, for payments. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and authorities as required by applicable law.

13. Third-Party Sites

The Services may link to websites we do not control. This Policy does not apply to those sites; please review their privacy policies.

14. Changes to This Policy

We may update this Policy from time to time. The current version will always be posted on the Site with its effective date. For material changes, we will provide additional notice as required by law. Your continued use of the Services after the effective date means you accept the updated Policy.
